Mental Distress

We have won the leading case in Canada on aggravated damages, those extra damages that the Disability Insurance Industry must now pay if a wrongful termination of payments results in mental distress. Mental distress can include things like not being able to pay bills on time, or having to move, or loosing your credit rating.

We recently won a major decision against Sun Life ( presently under appeal ) which extends the period in which a claimant can sue. If you have been denied by ANY insurance company in the last 10 years, you may still have a good claim.

To be sure of your rights, however, you MUST sue within ONE YEAR of the date you provide your claim to the Insurance Company , even if they have not refused to pay.
